These terms and conditions apply to all services and products offered through the website michieljanzen.com. By using our services, you agree to these terms and conditions.
Service provider: Michiel Janzen / Battlefield Tours. Customer: any natural or legal person who uses the services of the service provider. Agreement: any arrangement between the customer and the service provider regarding the provision of services.
Michiel Janzen offers tours and activities at various locations, including motorcycle tours through the Vercors, bicycle tours in Lyon and walking tours in Lyon.
If you participate in motorcycle tours, including tours through the Vercors, you declare that you hold a valid driving licence for the vehicle you will be riding. You also declare that you will arrange suitable travel insurance with roadside assistance, valid in France and covering at least repatriation of the vehicle. You are responsible for ensuring that your vehicle is in good condition. If Michiel Janzen determines that the motorcycle is not safe enough, that your riding behaviour creates unsafe situations, or that undesirable situations arise during the tour, he reserves the right to refuse your further participation.
By agreeing to these travel conditions, you declare that you will always make your own assessment about whether to deviate from routes if you consider this necessary. This may include fatigue, weather conditions, road surface quality, route length or any other variable that requires you as a traveller to make your own judgement. You are at all times responsible for the choices you make and for their consequences during the trip. You declare that you are in good health, that you have held a motorcycle licence for more than five years and that you have gained sufficient riding experience during that period, including experience riding in mountainous areas with steep and narrow roads. Participation in motorcycle tours is entirely at your own risk. Michiel Janzen cannot be held liable in any way for the occurrence or consequences of a traffic accident or any other damage.
If you participate in bicycle tours in Lyon or walking tours in Lyon, you must follow the guide’s instructions at all times. Participation in both bicycle and walking tours is at your own risk.
Michiel Janzen is not liable for loss, theft or damage to personal belongings during the tour. By participating, the customer declares that they are physically able to take part in the chosen tour.
A booking is only final after confirmation and payment of the agreed amount have been received. Payment must be made using the payment methods offered on the website. Cancellations and refunds are subject to our cancellation policy.
Cancellations up to 7 days before the start of the tour will be fully refunded. Cancellations within 7 days before the tour date will result in a 50% refund. Cancellations within 24 hours before the tour or no-shows are not eligible for a refund.
Michiel Janzen reserves the right to cancel or change tours in case of force majeure or unforeseen circumstances. If we cancel a tour, the customer will receive a full refund.
Complaints must be submitted in writing through the contact form on the website within 7 days after the service. These terms and conditions are governed by Dutch law, regardless of the fact that the services are carried out in France. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
If any provision in these terms and conditions is invalid or unenforceable for any reason, the remaining provisions will remain in force. The invalid provision will be replaced by a new provision that comes as close as possible to the original intention.
